Services Policy

What to Expect When Working With Us

Welcome to Prosper Landscape & Construction LLC. Please review our services policy, which outlines the key terms and conditions governing our projects. Please review your custom quote for full details on the services agreement.

 1. Scope of Services

We provide landscaping and construction services as detailed in your custom quote. Any work outside the quoted scope requires a written agreement and may incur additional charges.

 

2. Project Acceptance

By accepting our quote, you acknowledge and agree to the terms of this policy. All prices are valid for 30 days and may be adjusted if the project is delayed beyond that timeframe.

3. Payments​​

  • A 50% deposit is required to schedule work.

  • The remaining balance is due upon project completion.

  • Payments are accepted via credit/debit card, ACH, or check.

  • Late payments (over 7 days past invoice) will incur a 5% monthly late fee or a $75 flat fee, whichever is greater.​

4. Changes & Additions

All change requests must be submitted in writing and approved. Changes may affect pricing and project timelines.

5. Permits & Approvals

Clients are responsible for obtaining all necessary HOA approvals, permits, and permissions. We’ll assist by providing documentation if needed but are not liable for delays or denials.

6. Site Access & Conditions

Please ensure the job site is free of obstructions before we arrive. You must provide access to water, power, and utilities throughout the project. We are not liable for delays caused by site issues or unknown underground conditions.

7. Warranties

We stand behind our craftsmanship:

  • Hardscaping & Turf: 2-year workmanship warranty

  • Irrigation & Drainage: 1-year workmanship warranty

  • Artificial Turf Installation: 2-year workmanship warranty.

Warranty Limitations:
These warranties do not cover damage due to natural wear, extreme weather conditions, improper maintenance, soil movement, tree root growth, settling, heavy equipment use, or third-party modifications.

Any manufacturer warranties on materials are subject to the manufacturer’s terms and conditions.

 

Property Damage:
While every precaution is taken, the company is not responsible for pre-existing damage or unforeseen underground utility disturbances unless caused by negligence.

 

8. Cancellations

  • Within 48 hours of acceptance: Full refund minus $250 admin fee

  • Before scheduling crews or materials orders: Cancellation fee based on project value

  • After scheduling crews or materials orders: A portion of the deposit will be retained to cover incurred costs

  • The full cancellation structure is available in your agreement.

9. Delays

We are not responsible for delays due to weather, supply issues, or labor shortages, or other unforeseen events. We will stay in communication and reschedule as needed.

10. Indemnification

The client agrees to indemnify and hold Prosper Landscape & Construction LLC harmless from any claims, damages, or liabilities arising from the client’s failure to obtain necessary approvals, unforeseen site conditions, or any actions taken by the client that interfere with the project.

 

11. Photography

We may document project progress through photos for marketing purposes unless you request otherwise in writing prior to the start of work.

 

12. Dispute Resolution

​​In the event of a dispute, both parties agree to first attempt mediation. If unresolved, disputes shall be handled in accordance with Washington State laws and under the jurisdiction of the county where the project was performed, or another mutually agreed-upon jurisdiction.
